polygamy is one of the important themes that receive special attention from allah swt. even now, polygamy is considered there will be no end to debate. this is because of more and more rampant polygamy was practiced among the people of in indonesia. this gave rise to much comment among the public, either reject or support polygamy. differences of opinion concerning the legal status of polygamy in to comment on this matter due to differences in the understanding of the contect and purpose of surah an-nisa 'verse 3: many figures who argued with his thoughts on poligami. describing one of them is muhammad thalib's. this study aims to determine: 1) explain muhammad thalib's thingking about polygamy, 2) outlining the background foundation muhammad thalib's thingking about polygamy, 3) identfy the relevance of muhammad thalib's thingking about polygamy when associated with legislation in indonesia.
this type of reseach in this thesis is the library research, therefore dat as supporting reseach, the authors get from books or documents relating to this research. as the authors analyzed the data using descriptive method and comparrative analysis. it is the author do to get the commprehensive research. after the authors obtain and analyze data, according to muhammad thalib polygam is something that is conditional. follow legal circumstances of each person with the condition may be fair. his opinion is almost the same as the opinion of most scholars of fiqh general.
the rationale muhammad thalib's on polygamy is based on the qur'an surat an-nisa 'verse 3 and as-sunah of ibn abbas, sa'id bin jubair advise in order to marry a muslim and polygamous better than not polygamy as evidence a second after the qur'qn. his foundation. the understanding is done textually. muhammad thalib's thought primarily about polygamy there are some that are not relevant to the provisions of the applicable la in indonesia, especially the marriage law no. 1 of 1974 articles in law no. 1 1974 from 4 paragraph (1) and chapter 5 by muhammad thalib's beause men can justly be sure perpetuate his desire to marry the woman chosen without permission first wife or wives before and without court permission. and marriage is still valid according to the provisions of islamic syari'ah
